Terms and conditions for end consumers

Orders & deliveries

Simply order directly in our online shop. Alternatively, you can also call us or send us an e-mail. To enable us to process your order smoothly, please provide your full address, telephone number and customer number (if you already have one).

Shipping and packaging costs

New customers / first orders

Please understand that we reserve the right to ask for advance payment for new customers and first orders within Germany. 

For new customers outside Germany we generally ask for payment in advance. 

Alternatively, payments via PayPal or Amazon Pay are possible at any time.

Right of withdrawal and return

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail).

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of cancellation

If you cancel this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Storage of your personal data

We collect data such as your full name, address, telephone number etc. so that we can fulfil your orders in the best possible way. This personal data is stored by us when we process your order.

This enables us to keep you informed about our products and offers in the future, for example by sending you our customer information by e-mail and our free brochure. You can of course unsubscribe from receiving our advertising material at any time without incurring any costs.

We will always treat your personal data as strictly confidential and will of course never pass it on to unauthorised third parties (e.g. for their advertising purposes).

At your personal request, we will be happy to inform you about the type and scope of your data stored by us.

Liability & complaints

We usually need 2-3 days to process your order; rarely longer than 7 working days. However, in individual cases, delivery delays cannot be avoided. If possible, we will be happy to send you a partial delivery - unless you specify otherwise when ordering - and deliver the latecomer free of charge. Please understand that we accept no liability for delays in delivery, nor if an item is no longer available.

Please notify us immediately of any complaints regarding the scope of delivery, incorrect deliveries and deviations in quantity, but at the latest within 2 weeks of receipt of the goods. We will immediately take care of a smooth correction.

Please inform the relevant transport company immediately of any transport damage, as we can hold them liable for this.

Platform for online dispute resolution

The European Commission provides a platform for online dispute resolution (OS). You can find the platform at  http://ec.europa.eu/consumers/odr/. Please enter our email address kontakt@niem-handel.de as the contact address.

We are legally obliged to provide the above information from January 2016. However, we would still ask you to contact us directly first in the event of any complaints or dissatisfaction on your part!

Payment terms

Deliveries against invoice are to be paid within 14 days without discounts. 

Customers from other EU countries (European Union) are requested to pay by EU standard bank transfer. Bank charges for foreign bank transfers must be paid in full.

The delivered goods remain the property of Niem-Handel Gerald Moser, D-64579 Gernsheim until full payment has been received.
